In a bid to safeguard her iconic voice and image from the clutches of artificial intelligence (AI), pop sensation Taylor Swift has filed trademark applications for two audio clips and one stage photograph. Done through her TAS Rights Management, these filings aim to combat the growing issue of AI-generated deepfakes that utilize her likeness without permission.

The pop star's legal move comes in the wake of countless AI-created deepfakes featuring her likeness – from misleading ads to suggestive endorsements. While rights of publicity offer some shield against such unauthorized use, Swift's approach adds an extra layer of security via trademark law.

“While existing ‘Right of Publicity’ laws offer some protection against unauthorized use of a famous individual’s likeness, trademark filings can provide an additional layer of protection,” remarked trademark attorney Josh Gerben, who wrote about Swift's applications on his blog.

The Unique Audio and Image Under Lock

The audio clips Swift is seeking to protect feature her promoting her latest album, 'The Life of a Showgirl.' In the first clip, she invites listeners to enjoy her new album on Amazon Music Unlimited, while the second urges fans to pre-save the album for its release on Spotify. Adding to this, the trademark application includes a vibrant stage photo of Swift donning a sequined outfit and holding a pink guitar.

Trademark attorney Josh Gerben highlights that this use of trademark registration for a celebrity's spoken voice is unprecedented. "Historically, singers relied on copyright law to protect their recorded music," Gerben noted. However, as AI technology advances, the need for such innovative legal measures becomes crucial.

Taylor Swift isn't alone in this fight against AI deepfakes. Hollywood actor Matthew McConaughey has also stepped into the legal arena. Earlier this year, he shared with the Wall Street Journal his intent to set clear ownership boundaries, emphasizing consent in an evolving AI landscape.

As Swift seeks to safeguard her image and voice, her actions could pave the way for other celebrities to follow suit, marking a significant shift in how public figures manage their rights in the digital era.
